Research & Writing Attorney

Federal Defender Services of Idaho is now accepting applications for a Research and Writing Attorney in the Capital Habeas Unit located in Boise, Idaho.

Federal Defender Services of Idaho (“FDSI”) is the Community Defender Organization (see 18 U.S.C.§ 3006A(g)(2)(B)) for the District of Idaho. The organization’s main office is in Boise, Idaho with a branch in Pocatello, Idaho and a Capital Habeas Unit also in Boise. FDSI operates under the authority of the Criminal Justice Act, 18 U.S.C. § 3006A, to provide defense services to indigent persons in federal criminal cases and related matters in the federal courts.

The Capital Habeas Unit represents indigent defendants on death row in Idaho, California, and Nevada. Through an interdisciplinary team approach, we provide our clients with the highest level of legal representation with respect to their convictions and death sentences. CHU attorneys regularly litigate in federal district court, the Ninth Circuit Court of Appeals, and the United States Supreme Court. Our attorneys are zealous advocates of the highest caliber, devoted to ensuring our clients receive the best possible representation. Skilled collaboration, strategic litigation, compassionate representation, and unique approaches to the issues affecting our clients are among the values we aim to foster in our CHU.

Because no single person can do this work alone, you will work with experienced lawyers, mitigation specialists, and paralegals in the CHU. The Federal Public Defender’s Office is committed to improving diversity in the legal profession. The office is currently staffed by four attorneys, three investigators, three paralegals and related support staff.

Specifically, the R&W attorney will research and aid in drafting capital habeas petitions, motions relating to capital habeas litigation in the district court, and capital habeas appellate briefing.

Requirements: Applicants must be a graduate of an accredited law school and be a member in good standing of the highest court in the state where licensed. Applicants who are sitting for the bar exam this summer will be considered. No prior experience is necessary. You must also be a U.S. citizen or eligible to work in the United States. This position requires local and interstate travel. Employees of this program may not engage in other full-time employment or litigation assistance for hire.

The selected candidate will be subject to a background check or investigation and subsequent favorable suitability determination for employment. FDSI employees are considered “at-will” employees and are not covered by the Civil Service Reform Act and are not federal employees. This position is overtime exempt. Employment will be provisional and contingent upon the satisfactory completion of a 180-day probationary period. COVID-19 vaccination is required as a condition of employment, exceptions allowed with reasonable accommodation.

Salary: Competitive salary (Judicial Pay Scale: JSP Grade 9-15, $54,727-$170,532), health coverage, long term disability and life insurance, paid time off and federal holidays, and retirement plan.
